1. Deemed acceptance

1.1 By registering to this Portal, you are deemed to have accepted these terms of use (TOU), which are legally binding.

1.2 These TOU's may change at our discretion and at any time.

2. Definitions

“Content” means any content contained in the E-learning Tool.

“E-learning Tool” means Healthdirect’s Online Health Literacy Tool, which is comprised of a suite of online learning modules.

“Intellectual Property Rights” (IP Rights) means all intellectual property rights including rights in software and computer programs, copyrights, database rights, sui generis database rights, discoveries, concepts, domain names, patents, secret or other processes, technologies, know how, inventions, ideas, improvements, information, trade secrets, business methods, logos, documents, manuals, designs, trademarks, anywhere in the world existing now or in the future (whether any of the foregoing is registered or unregistered and including any application or right of application in relation to any of them).

“Portal” means this LearnUpon online portal/platform which hosts the E-learning Tool.

“Technology” means software, services, or other technology of this Portal, including the the infrastructure, hardware, networking, storage, and related technology required to operate and provide the Portal.

The information and Content contained in the E-learning Tool is not intended to be professional advice. Any information and Content contained in the E-learning Tool is for educational purposes only.

4. Disclaimer

4.1 No representation or warranty is made to the accuracy, reliability or suitability of the information or content of the E-learning Tool.

4.2 You acknowledge that your use and reliance of the E-Learning Tool, in any capacity; is completely at your own risk. Healthdirect excludes, to the maximum extent permitted by law, any liability, loss or damages in connection to the use of the E-learning Tool.

5. Your use

5.1 You may not copy, modify, adapt, translate, or otherwise create derivative works of any of the Technology or Content accessed from this Portal.

5.2 You agree not to store, distribute, upload or transmit any content through the Portal that is at risk of being:

1. perceived to be unlawful, embarrassing, harmful, threatening, bullying, libellous, defamatory, obscene, harassing, annoying, racially or ethnically offensive, inciting hatred or invasive of a person’s privacy;
2. facilitates or promotes illegal activity, violence, discrimination based on race, gender, colour, religious or philosophical belief, sexual orientation, disability or any other illegal activities;
3. depicts or contains sexually explicit or pornographic images; and/or
4. infringes the intellectual property rights of a third party.

6. Acceptable use

6.1 Your use of this Portal shall comply with any applicable laws and regulations.

6.2 We reserve the right to restrict your access to the Portal, should we deem that you have not complied with these TOU.

• wish to access and request correction of your personal information that is held by Healthdirect via this Portal; or
• make a complaint about the handling of your personal information and how your complaint will be dealt with by us.
